Terms of Service

These Terms of Service ("Terms", "Agreement") govern your use of the HelpCard app, website (helpcard.app), and related services provided by HelpCard ("we", "us", "our").

By using our Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. About HelpCard

HelpCard is a digital donation and financial aid platform that enables donors to securely send money to homeless individuals via a HelpCard (top-up card). Donations can only be spent at approved merchants to ensure responsible use.

2. Accounts and Registration

  • To use HelpCard as a donor, you must create an account using a valid email address or a Google account.
  • You are responsible for maintaining the confidentiality of your account and password.
  • You agree to provide accurate and complete information and to keep your account details up to date.

3. Eligibility

  • You must be at least 18 years old to create an account and make donations.
  • By using HelpCard, you confirm that you have the legal capacity to enter into this agreement.

4. Donations and Payments

  • Donations are processed via secure third-party payment providers (Stripe, Apple Pay, Google Pay). We do not store your raw payment card details.
  • HelpCard charges a transaction fee of 1-2% per donation.
  • Donations made through HelpCard are non-refundable.
  • Payments to HelpCard recipients are subject to spending controls and can only be used at approved merchants (such as supermarkets, hostels, and hygiene stores). Cash withdrawals and non-essential purchases are restricted.

5. Use of the Service

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to interfere with the functionality or security of the Service.
  • Impersonate another person or misrepresent your affiliation with an organisation.
  • Use the Service to transmit or distribute spam or malicious content.

We reserve the right to suspend or terminate your account if you violate these Terms.

6. Donor Rewards and Incentives

  • Donors may receive milestone rewards based on their donation history. These may include discounts, vouchers, or offers from partner stores.
  • Rewards are provided at our discretion and may be subject to availability, change, or withdrawal without notice.

7. Impact Reports and Communications

  • Donors may opt-in to receive impact reports and updates on how funds are used.
  • By using the Service, you consent to receive transactional emails related to your account, donations, and service updates.

8. Intellectual Property

All content, branding, and intellectual property associated with HelpCard, including the app design and platform features, are owned by HelpCard and its licensors. You may not reproduce, distribute, or create derivative works from our content without prior written consent.

9. Partnered Stores and Organisations

  • HelpCard ensures that issued cards function seamlessly at approved merchants using standard, secure payment processing systems. Partnered merchants agree to accept HelpCard payments in line with our partnership guidelines.
  • Partnered charities may act as distribution points for HelpCards, helping to ensure the cards reach the intended recipients and target communities effectively.

10. Service Availability

We strive to ensure the Service is available at all times but do not guarantee uninterrupted access. We may suspend, modify, or discontinue any part of the Service without notice.

11. Limitation of Liability

  • HelpCard provides the Service on an "as is" basis. To the maximum extent permitted by law:
  • We do not guarantee the Service will meet your expectations or requirements.
  • We are not liable for indirect, incidental, or consequential damages arising from your use of the Service.
  • Our total liability under these Terms shall not exceed the total amount of fees paid by you to us, if any.

12. Indemnification

You agree to indemnify and hold harmless HelpCard and its affiliates from any claims, damages, or expenses arising from your use of the Service or your violation of these Terms.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your data. You can review it at https://helpcard.app/privacy.

14. Termination

We may suspend or terminate your access to the Service at any time if you breach these Terms or if required by law.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through the Service. Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
